Welcome to the T9HobbySport website terms and conditions for use. These terms and conditions apply to the use of this website at www.t9hobbysport.com. By accessing this website and/or placing an order, you agree to be bound by these terms and conditions.


Using this website indicates that you accept these terms regardless of whether or not you choose to register with us or order from us....

Ordering

To place an order on our website could not be easier. Simply browse our products, select the items of your choice, click "add to basket", enter the quantity you require, click "continue shopping" if you wish to make other purchases or "checkout" to proceed to make payment. If you have made an error simply click the delete icon next to the product you do not wish to purchase.

When you place an order with us, you are making an offer to buy goods at the advertised price, and confirming that you are over 18 years of age. We will send you an e-mail to confirm that we have received your order. If the goods are no longer available or we have made a pricing error we will advise you and there will be no contract between us. There will be no contract between us until the goods are ready for dispatch, even if your payment has been processed immediately.


We may refuse to accept an order: (a) where the goods are not available; (b) where we are unable to obtain authorisation for your payment; (c) if there has been a pricing or product description error; or (d) if you do not meet the eligibility criteria set out above.


We accept payment by Visa, MasterCard, Maestro, Switch, Solo or Amex.


If you wish to pay by cheque, then please send it (payable to T9HobbySport), with your order to our trading address above.


Pricing

Where we charge separately for packing, postage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on this Website.


Although we make every effort to ensure that all pricing information on the Website is accurate, there may be rare instances where an error in pricing occurs. Should we discover a pricing error we will contact you and ask you whether you wish to cancel your order or continue with your order at the correct price. We will not be obliged to supply goods at a price shown in error.


Prices that are reduced for sales and promotions are valid for the specified period only. We reserve the right to adjust prices, offers, goods and specifications of goods on the Website at our discretion at any time before (but not after) we accept your order.


Product Portrayal

Every effort has been made to portray items accurately, but slight variations may occur. All specifications and detail is as close as publishing processes will allow.


Delivery

UK Delivery charges start from of £1.99 per order, postage costs can vary dependant on weight, size and value. Postage cost for any order are quoted in the checkout process before you commit to purchasing.


Customers should receive their goods within 2 to 5 working days.


Goods are dispatched by Royal Mail First Class, Parcel 24 service or DHL. The vast majority of goods dispatched by this service do arrive next day, however, this is not guaranteed.


If the goods are lost or damaged in transit, please let us know promptly.


Cancellation & Returns

You can cancel your contract at any time up to 10 working days after receiving the goods. All that we ask is that you return items in a saleable condition, unused, with the original packaging and all labelling intact. We would strongly advise you to obtain proof of posting (free from your Post Office) as unfortunately we cannot be responsible for returns lost.


Returns & Exchanges

In the event that you require a refund or an exchange, we require that you return the new and unused goods to us within 10 working days of receiving the goods. New and unused means there are no marks on the item and the item has been returned to us, unused and in saleable condition. T9HobbySport will not accept returns/exchanges for any non-faulty items that have been used and can be subject to a 10% handling charge if opened. Please note, we cannot refund shipping and/or delivery charges. All items purchased on the t9hobbysport.com web site must be returned to our address stated, at the responsibility of the sender and we cannot be held responsible for items lost or delayed when being returned.

Exchange


In the event of an exchange, items are subject to product availability and the customer will incur any shipping costs for returning items to be exchanged. All exchange enquiries can be made by contacting T9HobbySport. Exchanged items can only be dispatched after the returned goods have been received and undergone a quality control check.


How to proceed with your return or exchange

To do this, please drop us an e-mail to [email protected] we never ask you for a reason for your cancellation, however, a brief explanation will help us to improve the service we offer to customers in the future.


Indicate whether you would like to make a return or exchange. Exchanges will be subject to our stock availability.

We recommend that you send all items insured and/ or registered when sent through the mail as we cannot take responsibility for packages which we do not ship ourselves.


Once we have received your package, we will process your refund request. Once your goods have been examined and verified, your payment will then be refunded to the card that was used to make the original payment, usually within 14 days of us receiving the goods.


Please note:

We do not accept cancellations or returns after 10 working days have elapsed from the receipt of the order. This cancellation policy does not affect your statutory rights.


Faulty Goods

If there is a problem with the goods, please contact us as soon as possible by e-mail at [email protected] or by telephone on 07957 190845, and we will do all we can to resolve the problem. Your statutory rights are unaffected.


Privacy and Security

As an internet and mail order company your privacy and security is of up most importance to T9HobbySport. In order to fulfill an order placed with us, we do need to collate and store personal information including your name, email address, phone numbers, home address, shipping address and credit card billing address. We keep a record of this information in order that we may process your order and recognise you as a registered customer. The information we gather from our customers helps us to improve your shopping experience and to update our services. It also helps us to prevent and detect fraud.


We will keep a record of any e-mail correspondence you send us and orders you place with us so that we may deal with any problems you may experience with your purchases or other issues. T9HobbySport will store your personal information on a secure server and will treat it as confidential. We use a Secure Socket Layer (SSL) encryption which encrypts your information before it is sent to us to protect it from unauthorised use.


We will never pass your personal information to a third party for marketing purposes.


In order to process your order we may have to cross check your personal details with our payment provider, Paypal, however, your credit card details are entered directly onto Paypal’s systems, and are neither transmitted nor held beyond this transaction process on T9HobbySport systems.


As a user of our services, we may collect non-personal data about use of the website, such as pages visited, times and volume of use of the services as well as Traffic Data. Traffic data includes logs, details of networks, time of log-on or access, length of sessions and similar systems data.

T9 Hobby Sport Trading Terms and Conditions (reference to Trade customers only)


T9 hobby Sport is a UK-based distributor of MKS products. T9 hobby Sport provides its products and services based on the terms and conditions presented in these Terms and Conditions. By using T9 Hobby Sport’s services you agree to be bound by these terms & conditions.


We reserve the right to amend Terms and conditions at any time. Any time you order from us, the Terms in force at the time of your order will apply.


Trade Customers ("Traders")


Businesses wishing to retail MKS products or any other product we retail, must apply to open an account with T9 Hobby Sport. At our discretion, T9 Hobby Sport may call you in order to discuss your particular trade requirements and may request a visit at your premises at your convenience in order to ascertain trade status.


T9 Hobby Sport reserves the right to refuse or withdraw facilities, close accounts, withdraw discounts and trade pricing without notice and at our discretion.


Conditions of Sale


Goods are offered for sale subject to availability and are sold subject to these Trading Terms and Conditions.


Title and Risk


Title remain the property of the T9 Hobby sport until such time that payment has been received in full. Title is retained over all goods previously supplied to the value of outstanding invoices.

The risk in the goods shall pass from T9 hobby Sport to the Trader upon delivery of such goods at the designated shipping address.


Backorders


Goods on an order that are out-of-stock at the time the order is processed will be placed on 'backorder'. Goods on backorder that come in stock will automatically be sent out on receipt if payment for the issued invoice is completed. Normal carriage terms will apply.


Deliveries


All discrepancies or damaged deliveries must be marked as such on any relevant carrier documentation and reported to our sales office on the day of delivery into your premises.


Please check deliveries carefully for damage and for missing item. We are unable to process claims for goods signed as received in good order which upon later investigation in the shop are found to have damage. Similarly, we are unable to process claims for missing items that have been signed in by you or your staff as delivered into your premises.

Due Dates and Delivery Dates are provided as estimates only.


Returns


No goods, faulty or otherwise can be accepted by T9 hobby Sport without prior consent and arrangement. T9 Hobby sport will not be held liable for any third party charges/costs associated with returned goods.


Faulty goods should be returned T9 hobby Sport with details and a detailed receipt obtained at the time of return, with details of the invoice number relating to the goods in question and the nature of the fault. T9 hobby sport will be pleased to advise you if--and to where or to whom--a return should be made.


Goods returned as faulty but which are found upon examination by our technical service staff to be free of any fault will, at our discretion, incur a handling and examination charge. Goods supplied over 12 months ago will not be eligible for credit.


Restocking & Carriage Charges


We reserve the right to apply, at our discretion, a restocking charge on any items returned for credit which have been correctly supplied in good faith and in good condition by T9 Hobby Sport.


Carriage Charges


UK Mainland

Goods value over £250 will be sent carriage free, unless the parcel has none trade items in shipment.

Orders under this value will incur a carriage charge at our discretion.


Statements & Invoices


A statement of your account and invoices will be available at any time on the online platform. Please check that all transactions agree. If they do not, please contact T9 Hobby sport immediately.


Credit Facilities


Credit facilities are not available at T9 Hobby Sport.


We require full payment of invoice before dispatch of goods. Invoices are dated on the day orders are received. Any invoice raised becomes due for payment 7 days from the time the invoice is dated.


Overdue Balances


If for any reason the goods are sent out before full payment received, T9 Hobby Sport reserves the right to demand payment of all outstanding invoice, whether or not overdue, if a customer goes overdue on any invoice. T9 Hobby sport reserves the right to charge customers on a full indemnity basis for any costs or recovering or attempting to recover late payments.


Trade Prices & Suggested Retail Prices ("SRP")


We reserve the right to change prices at any time at our discretion without prior notification.


Trade prices shown are exclusive of VAT. SRP prices are inclusive of VAT and can be provided on request via the price lists and are intended to be helpful guide prices only and are in no way binding.


The prices of the Products will be as quoted at the time you submit your order. We take all reasonable care to ensure that the prices of products are correct at the time when the relevant information was entered onto the system. If we discover an error in the price of the Products you have ordered with will contact you to inform you of this error and will give you the option of continuing to purchase the Product at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details we have on record, we will cancel the order and notify you.


Discounts


Discounts may be made available entirely at T9 Hobby Sports discretion and subject to terms.


Payment Charges


Payments by BACS, debit card, credit card incur no payment charges.


Events Outside Our Control


We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by any act or event beyond our reasonable control, including without limitation fire, explosion, storm, flood, failure of public or private telecommunications networks, or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transportation.
